The Collaborative Process
In a collaborative law setting, two qualified lawyers who have been certified in collaborative law use a team approach to reach an agreement outside of the court process using principled negotiations and cooperative settlement discussions. Using non-adversarial and mediation type skills to create an open dialogue, 4-way meetings are set up to discuss the points of contention. Both parties receive independent legal advice throughout the process, and in the event that the outstanding legal issues are resolved, all the legal documents are ratified between the two cooperating lawyers and their respective clients.
